GA Centric – Terms of Service
These are general terms that you must accept in order to use our software, GA Centric, whether as a free trial user or as a paid customer. There may be additional terms specified when you selected your license for purchase. Those terms will always take precedence over similar terms listed here (e.g. your product’s subscription duration may override the default subscription duration). Accepting these terms also indicates you accept any such overriding terms.
We may change these terms of service at any time by updating this page on our website. For existing accounts, the new terms will come into effect 30 days after the terms are updated here.
As a Google Apps domain admin, you may install GA Centric on your domain, or login to GA Centric directly by authenticating with your Google account on that domain. By using either method, an account corresponding to your Google Apps domain will be created on GA Centric (“your account”). Other Google Apps admins on your domain will also be able to access the same account that you created. If another Google Apps admin previously created a GA Centric account then you will automatically access the account they created on behalf of your Google Apps domain.
Your acceptance of the terms contained in this page is implicit by your use of any of our web sites or software (www.gacentric.com or app.gacentric.com).
On creation, your account will begin a free 14-day trial of the GA Centric software. After your trial, you will be able to continue using the software by upgrading to a paid subscription plan. The plan pricing will depend on the number of users in your Google Apps domain. Payment will be taken by credit card or similar means in advance of each month of service of the software.
All licenses are non-transferable.
Queries about installing or using the software should be emailed to email@example.com. For support requests received during business hours in the UK, we will take reasonable steps to respond within 24 hours of receipt. For support requests not received during business hours in the UK, we will take reasonable steps to respond within 24 hours of the start of the next working day.
Support is only available to admins of a Google Apps domain that has a GA Centric account currently in a free trial or in a paid subscription.
We reserve the right to refuse to assist with support requests where you have failed to pay for your paid subscription, or if we have reasonable grounds to believe you are misusing the software.
We offer a free trial for the first 14 days of your GA Centric account. This is designed to give you the time to try out the software and confirm that it meets your needs.
If you are unhappy with the service at any time after starting a paid subscription, you may request a refund of only the most recent license fee paid. Such a refund may be made entirely at our own discretion. Please contact us via firstname.lastname@example.org explaining why you would like to request a refund. This may or may not be in conjunction with a cancellation of your subscription (see below).
At any time following the creation of your GA Centric account, you may request to terminate your account by emailing email@example.com from the email address of a Google Apps admin for the domain under which your account was created. Allowing for 5 working days to process your request, we will terminate your account. If you are in a paid subscription, no further charges will be applied to your account. If any charges are applied during the time that it may take to process the termination, those charges will be refunded. However, no refunds will be given (unless otherwise at our sole discretion) for previous payments, including part payments taken for services that had not yet been delivered at the time of the request.
We reserve the right to suspend your account due to non-payment or if we have reasonable grounds to believe you are misusing your account.
Upon creation of your GA Centric account, the email address you entered for your contact details will be stored in our system. We will send you ‘transactional’ emails directly regarding your account (such as security warnings or advance notification that your subscription is due to expire). We will also add your email address to any relevant email distribution lists, such as one that provides ideas for getting the most out of your subscription, and those emails will each contain an ‘unsubscribe’ link so you can remove your email address from the list at any time. It is not possible to remove your email from our ‘transactional’ database without also agreeing to terminate your subscription to the product (which will only result in any refund if we so decide at our sole discretion or in accordance with our refund policy). We will never share your email address with any third party unless we have your permission or are required to do so by law.
THE AUTHOR OF THIS SOFTWARE (LESTERLAND LTD) ACCEPTS NO LIABILITY FOR ANY DAMAGE WHATSOEVER RESULTING FROM USE OF THE SOFTWARE. THE SOFTWARE IS PROVIDED “AS IS”, AND YOU ARE RESPONSIBLE FOR ENSURING THAT IT IS SECURE AND FIT FOR PURPOSE WITHIN YOUR OWN GOOGLE APPS SETUP. THE AUTHOR’S LIABILITY IS STRICTLY LIMITED TO THE MOST RECENT SUBSCRIPTION FEE YOU HAVE PAID.
The software may rely on API services offered by Google as part of a separate contract you have with them through Google Apps. We are not responsible for any changes to those APIs including outages, alterations to their functionality or method of invocation, or discontinuation. If permanent changes made by Google affect the functionality of our software, then during the term of any current paid subscription, we will make reasonable attempts to work around those changes (if possible) within a reasonable time frame, but we cannot be liable for such changes.
